Article 1 — Parties
Seller: İBRAHİM KELOĞLU, Esentepe Mah. Yenibahar Sok. No: 6-8 D: 11, Eyüp / İstanbul, Türkiye. Gaziosmanpaşa V.D. — 5430564009. Phone +90 534 309 74 33, e-mail info@mapdecoder.com.
Buyer: the person or company whose details are entered on the payment page when the order is placed.
Article 2 — Subject
This agreement governs the sale of a Map Decoder software licence ordered electronically through this site, and sets out the rights and obligations of both parties under the Turkish Consumer Protection Law no. 6502 and the Regulation on Distance Contracts.
Article 3 — Product and price
The product is an annual licence for the Map Decoder software, in the plan selected by the buyer. The scope of the plan and its price, taxes included, are those published on the pricing page at the moment of the order.
No delivery, shipping or service fee is added to the published price.
Article 4 — General provisions
The buyer confirms having read the Preliminary Information Form before placing the order and having been informed of the seller's identity, the product, the total price, the payment and delivery arrangements and the right of withdrawal.
The licence is personal to the buyer's account and is used under the terms published on this site. The buyer is responsible for the lawfulness of the use made of the software and of the files processed with it.
Article 5 — Delivery
Delivery is electronic. After payment confirmation an account set-up link is sent to the e-mail address on the order; delivery is completed when the licence is registered to the account the buyer creates with that link. The link is normally sent immediately and in any case within 24 hours of payment confirmation. The licence term starts on the date of payment confirmation.
If delivery cannot be made at all, the seller informs the buyer and returns the payment in full within fourteen days.
Article 6 — Payment
Payment is made through PayTR, a licensed payment institution, on its own secure page. Card details are not transmitted to or stored by the seller.
If the payment is not completed or is later reversed by the bank, the seller may suspend or cancel the licence.
Article 7 — Right of withdrawal
The right of withdrawal does not apply to digital content supplied immediately and not on a physical medium, where supply has begun with the buyer's prior consent and acknowledgement of the loss of that right — Article 15/1-(ğ) of the Regulation on Distance Contracts.
The buyer gives that consent expressly on the order page before payment. Until the licence is activated the order may still be cancelled and the payment is returned in full.
This clause does not affect the buyer's statutory rights in case of a defective or non-conforming product.
Article 8 — Default
If the buyer pays by card and defaults towards the card issuer, the terms of the buyer's card agreement apply between the buyer and that issuer. The seller's rights arising from the unpaid amount are reserved.
Article 9 — Disputes
Complaints are addressed to the seller first. For consumer buyers in Turkey, the District/Provincial Consumer Arbitration Committees and Consumer Courts at the buyer's place of residence or at the place of the transaction are competent, within the monetary limits announced each year by the Ministry of Trade.
For buyers who are not consumers, and for buyers outside Turkey, the courts and enforcement offices of Istanbul are competent and Turkish law applies.
Article 10 — Effect
The agreement takes effect when the buyer confirms the order on the payment page. A record of the order, the Preliminary Information Form and this agreement is kept by the seller together with the confirmation date.
